Controversial Texas social media law HB 20 takes effect today following a US appeals court ruling. Trade groups NetChoice and the Computer and Communications Industry Association (CCIA) succeeded in blocking HB 20 from court last year, but that victory has been overturned by the Fifth Circuit Court of Appeals, which was announced today. The verdict follows a confusing hearing where a fifth circuit judge argued that web services like Twitter “are not websites” and compared them to telephone companies like Verizon, which are governed by specific common carrier rules established by the FCC. NetChoice and the CCIA can choose to appeal, but without prompt intervention from a higher level such as the Supreme Court, the law is now in effect.

“In an unusual and unfortunate move, a divided 2-1 Fifth Circuit panel lifted the order without ruling on its merits and without issuing an opinion explaining the order.
